Although our process is flexible depending on the debtor, the basic steps we follow are these:

  • Identify where the debtor can be reached.
  • Send a demand letter, detailing the basis for the claim against the debtor, providing notice of the debtor’s rights as required by law, and requesting prompt payment.
  • Wait 30 days as required by law.
  • Send a second demand letter.
  • If no response is received in 14 days, send attorney letter, notifying the debtor that litigation may proceed.
  • Perform due diligence for client, giving an overview of the case and our opinion on prospects for recovery.
  • File legal action.
  • Secure judgment.
  • Request enforcement provisions from court, which usually entails attaching the debtor’s vulnerable assets such as bank accounts, income from various sources, business assets, and real property.

Results always depend on the circumstances of the individual debtor. Some will try to discharge the debt through bankruptcy. When that happens, we assert our client’s right to as great a repayment as possible. However, under a variety of circumstances, our approach generally gives our clients a much greater chance of recovering all of the debt or a more substantial portion than would be achieved through other methods.
