Dependable Collections Defense Attorneys Represent Creditors in Newark, NJ

Helping Essex County businesses and professionals minimize losses

Your business or professional practice can suffer substantially if clients do not pay their bills, but often the law seems to favor debtors and leave creditors with few options. You can even get yourself into greater trouble, exposing yourself to civil liability, if you inadvertently violate any consumer protections. Fortunately, Rothbard, Rothbard, Kohn & Kellar is available to help. Since 1978 our commercial law firm has helped businesses recover payments from delinquent clients. Our collections practices comply with all applicable state and federal laws, including the Fair Debt Collection Practices Act, and we have a high rate of success. Don’t let your business hemorrhage red ink because clients refuse to pay. Let our established and reputable law firm take effective action for you.

Experienced collecting unpaid debt from various commercial transactions

Our collections attorneys represent a wide variety of businesses and professionals that produce goods or provide services. We regularly pursue collections for:

  • Goods sold or delivered — As commercial litigation attorneys, we are steeped in the Uniform Commercial Code and pursue all remedies for nonpayment. We also represent contractors, subcontractors, suppliers and material men in the construction industry.
  • Unpaid loans — We represent banks, savings and loans, credit unions, investment banks, and other lending institutions in collections of secured and unsecured debt.
  • Monies owed to professionals — We represent professional associations and individual practitioners in various fields, such as accounting, architecture, engineering, medicine, dentistry, surgery, and the law.

Many businesses are too quick to write off debt as a loss or sell debt for pennies on the dollar to a collection agency. While some debt is simply not worth pursuing, we can perform a thorough investigation and cost/benefit analysis so you can make a fully informed decision. Often our services are much more cost-effective than other available options.

Effective procedures in full compliance with the FDCPA

The Fair Debt Collection Practices Act places a great deal of responsibility on the debt collector to behave professionally, rather than in a threatening, abusive, or deceptive manner. We adhere scrupulously to the law, so you never have to fear civil liability for unlawful collection practices.

Although our process is flexible depending on the debtor, the basic steps we follow are these:

  • Identify where the debtor can be reached.
  • Send a demand letter, detailing the basis for the claim against the debtor, providing notice of the debtor’s rights as required by law, and requesting prompt payment.
  • Wait 30 days as required by law.
  • Send a second demand letter.
  • If no response is received in 14 days, send attorney letter, notifying the debtor that litigation may proceed.
  • Perform due diligence for client, giving an overview of the case and our opinion on prospects for recovery.
  • File legal action.
  • Secure judgment.
  • Request enforcement provisions from court, which usually entails attaching the debtor’s vulnerable assets such as bank accounts, income from various sources, business assets, and real property.

Results always depend on the circumstances of the individual debtor. Some will try to discharge the debt through bankruptcy. When that happens, we assert our client’s right to as great a repayment as possible. However, under a variety of circumstances, our approach generally gives our clients a much greater chance of recovering all of the debt or a more substantial portion than would be achieved through other methods.
